In order to participate effectively in the authorities ' decision making process, access to information is a necessary precondition which is reflected in most of the national and international regulations.Access to information, which is recognized in the constitutions or statutes of the most of the states as a right for people, is consisted of the most of the governmental information as well as environmental information. The regulations which guarantee citizens' right to justice, award them the right to access to necessary information as well.In international level, public participation and access to information has been recognized in principle 10 of Rio Declaration 1992 which holds:” each individual shall have appropriate access to information concerning the environment that is held by public authorities and States shall facilitate and encourage public awareness and participation by making information widely available. Effective access to judicial and administrative proceedings, including redress and remedy, shall be provided.Although there is nothing new in Rio Declaration, since most of its issues have been reflected in older international instruments, but in regional level Arhuss convention 1998 has been devoted completely to triple concepts of principle 10 and presents a set up for its implementation. This article as a result of the note worthy significance of Aarhus convention as a model for access to the information and administrative has compared and contrasted the element of access to information in Iranian law and Arhuss convention.A comparative study of these two instrument bring a question to the mind about the adequacy of 1387 law. Can this law meet the requirement of people for access to information about environmental issues in a way that pave the road for national participation in governmental decision making process which has been emphasized in Arhuss Convention? It seems 1387 law can meet the requirement although it is not a mere environmental regulation. Free access to information is limited and on the other hand there are relatively a wide range of classified and secret subjects.The law suffers from the lack of an implementation guide. The law is not enforceable in the case of lack of access to information. That is pretty obvious that a new law must be ratified in order to cover the shortcomings of 1387 law.}, keywords = {accsess to information,Public Participation,Rio Dclarion,Arhuss convention,Evaluation of environmental impacts}, title_fa = {مطالعه تطبیقی دسترسی آزاد به اطلاعات زیست محیطی در قوانین موضوعه ایران و کنوانسیون آرهوس}, abstract_fa = {حق دسترسی به اطلاعات زیست‌محیطی پیش‌شرط مشارکت مؤثر عمومی در تصمیم‌سازی مقامات عمومی، و نظارت بر فعالیت‌های حکومتی و بخش خصوصی است و می‌تواند در طرح‌ریزی و بهره‌برداری بهینه از فن‌آوری موجود مفید واقع شود. پی‌آمدهای تخریب زیست‌محیطی، اطلاع‌رسانی به هنگام و کامل را برای انتخاب آگاهانه گزینه‌ها، گریزناپذیر می‌کند. در این باره اسناد بین‌المللی حقوق بشری دربردارنده حق بر آزادی اطلاعات و وظیفه دولت‌ها نسبت به اطلاع‌رسانی هستند. در این رابطه، اعلامیه جهانی حقوق بشر، میثاق بین‌المللی حقوق مدنی و سیاسی، اعلامیه حقوق و وظایف انسانی دولت‌های آمریکایی، کنوانسیون حقوق بشر دولت‌های آمریکایی و منشور آفریقایی حقوق و وظایف مردمان، دسترسی به اطلاعات را به مثابه حق و حقوق مورد تاکید قرار داده‌اند. جدای از تضمین‌های حقوق بشری در خصوص حق دسترسی به اطلاعات توافقنامه‌های گوناگون زیست محیطی نیز وظایفی را به منظور اطلاع‌رسانی عمومی به دولت‌های عضو تحمیل می‌کنند، مانند کنوانسیون هلسینکی در مورد حفاظت و استفاده از آبراه‌های فرامرزی و دریاچه‌های بین المللی. در سطح بین‌المللی علاوه بر بیانیه ریو (1992) که در اصل 10 دسترسی به اطلاعات را به رسمیت شناخته است، کنوانسیون آرهوس (1998) مصوب کمیسیون اقتصادی سازمان ملل برای اروپا نیز حق دسترسی به اطلاعات را به نحو شایسته مورد بررسی قرار داده است. نظر به اینکه قانون انتشار و دسترسی آزاد به اطلاعات در سال 1387 خورشیدی برابر با سال 2007 میلادی به تصویب شورای اسلامی ایران رسیده است، در این پژوهش عنصر دسترسی به اطلاعات را در هر دو سند مورد بررسی و مقایسه قرار داده، تا به این پرسش مطرح پاسخ گوید که آیا قانون انتشار و دسترسی آزاد به اطلاعات می‌تواند پاسخ‌گوی نیازهای مردم پیرامون موضوعات محیط زیست بنحوی باشد که در کنوانسیون آرهوس منعکس است؟ یافته های این مقاله نشان می‌دهد که، قانون انتشار و دسترسی آزاد به اطلاعات به لحاظ ممنوعیت زیاد در ارائه اطلاعات تحت عنوان «محرمانه»، پاسخ‌گوی نیازهای جامعه در عصر انفجار اطلاعات نیست و ضرورت های غیرحقوقی دسترسی بیشتر به اطلاعات در حوزه محیط زیست به شکل گیری کنوانسیون آرهوس منجر شده است.}, keywords_fa = {دسترسی به اطلاعات,مشارکت عمومی,محیط زیست,بیانیه ریو,کنوانسیون آرهوس}, url = {https://www.iisajournals.ir/article_46941.html}, eprint = {https://www.iisajournals.ir/article_46941_a35816a9e5e2608b1c7176660cb65236.pdf} }
