A suspended contract is one whose effect depends on another matter according to the clause. However, according to some jurists, a suspended contract is invalid. But their main reason is consensus. Due to the fact that currently pending contract is a conventional and common contract in all systems and in international law. For this reason, ruling to invalidate it in all cases is against the common practice and jurisprudence and legal principles. This research has been done analytically and descriptively by referring to the library and using reliable jurisprudential and legal sources. In this research, the types of suspension are discussed. Then, taking into account the structure of suspension in the will and Ja'ala(contract of reward) and Racing &shooting And based on the obligatory conditional and suspended format, the ruling is valid for the suspension of contracts. بسیاری از عقود و قراردادهای داخلی و بین‌المللی بین اشخاص حقیقی و حقوقی و حتی عهدنامه‌های بین‌المللی بین دولت‌ها و سازمان‌های بین‌المللی ممکن است به صورت معلق و یا مشروط و منوط به تحقق و یا آماده سازی و فراهم نمودن شرایط و یا بستر لازم شده و به اصطلاح به صورت معلق باشند. عقد معلق آن است که که تاثیر آن بر حسب انشا موقوف بر امر دیگری باشد. هر چند از نظر برخی از فقها عقد معلق باطل است. اما عمده دلیل آنها اجماع است. با توجه به اینکه هم اکنون عقد معلق در همه نظام‌ها و در حقوق بین‌الملل متعارف و رایج است. به همین دلیل حکم به بطلان آن برخلاف رویه متداول و اصول فقهی و حقوقی است. سوال این است که چه تفاوتی بین انواع تعلیق است؟ آیا تعلیق در قراردادهای بین المللی با قراردادهای داخلی متفاوت است؟این تحقیق که با مراجعه به کتابخانه و با استفاده از منابع معتبر فقهی و حقوقی به صورت تحلیلی و توصیفی انجام گرفته است. ضمن تفکیک اقسام تعلیق از صحت تعلیق براساس ساختار تعلیق در وصیت و جعاله و سبق ورمایه و براساس قالب واجب مشروط و معلق دفاع می کند و هیچ تفاوتی بین تعلیق در حقوق داخلی و بین الملل نیست. بنابراین طرفین قرارداد معلق باید دارای حسن نیت بوده و همکاری متقابل داشته باشند. https://www.iisajournals.ir/article_219353_fd30301a85b78398c62a4ed69d089366.pdf
